1. Acknowledgment of Activities

I understand that the Hoosier Frontier Trail is an interactive outdoor trail that may include demonstrations or hands‑on use of early technologies, tools, equipment, and historical methods. Activities may involve walking on uneven terrain, interacting with mechanical devices, observing demonstrations, and participating in optional skills‑based experiences.

2. Assumption of Inherent Risks

I acknowledge that outdoor recreational activities and interactive demonstrations involve inherent risks, including but not limited to:

• Slips, trips, and falls

• Uneven ground, roots, rocks, and natural hazards

• Weather conditions

• Contact with tools, equipment, or early‑technology devices

• Wildlife encounters

• Physical exertion

• Risks associated with voluntary participation in demonstrations

I understand these risks cannot be eliminated without altering the nature of the activity.

I voluntarily choose to participate and assume full responsibility for all risks, whether known or unknown.

3. Indiana Recreational Use Statute Notice (IC 34‑31‑9)

I understand that under Indiana law, a landowner who allows others to use their land for recreational purposes without charging a fee for entry is generally not liable for injuries resulting from such use.

I acknowledge that any fees charged by the Hoosier Frontier Trail are for programming, instruction, equipment, or services, and not for access to the land itself.

4. Agritourism Activity Warning (IC 34‑31‑5.5)

WARNING: Under Indiana law, an agritourism provider is not liable for an injury to, or the death of, a participant in agritourism activities resulting from the inherent risks of such activities. Inherent risks include dangers or conditions that are an integral part of agritourism activities, including the risk of injury from the land, equipment, and animals, as well as the potential for the participant to act in a negligent manner.

By signing below, I acknowledge this warning.

5. Release of Liability

In consideration for being permitted to access and participate in activities on the Hoosier Frontier Trail, I hereby:

• Release and discharge the landowner(s), operators, volunteers, staff, and affiliated organizations from any and all claims, demands, or causes of action arising from participation, except in cases of willful or wanton misconduct as defined by Indiana law.

• Agree that this release applies to injuries, damages, or losses caused by inherent risks of outdoor or interactive activities.

6. Indemnification

I agree to indemnify and hold harmless the Hoosier Frontier Trail, its owners, staff, and volunteers from any claims brought by me or on my behalf, or by third parties arising from my actions during participation.

7. Medical Authorization

I authorize the Hoosier Frontier Trail staff or volunteers to obtain emergency medical care for me if needed. I understand I am responsible for all associated costs.

8. Participant Responsibilities

I agree to:

• Follow all posted signs and staff instructions

• Use equipment only as directed

• Refrain from unsafe behavior

• Supervise any minors in my care

Failure to follow safety instructions may result in removal from the property.

9. Photography Release (Optional)

I grant permission for photographs or video taken during my visit to be used for educational or promotional purposes. ☐ I agree  ☐ I do not agree

10. Severability

If any portion of this agreement is found unenforceable, the remaining sections shall remain in full effect.
